Local 11 appeals 'decert' loss at CNF


Office and Professional Employees Local 11 has filed several objections against CNF Service Company for its conduct in a decertification election in which the union narrowly lost 118 to 120. The vote was held Oct. 2.

The union charges CNF with violating a “24-hour rule” after the company held a mandatory employee meeting the morning of the election at which a manager discussed the election with more than two dozen workers

Local 11 also filed a complaint against the company for denying union representatives access to bargaining unit members soon after the decertification petition was filed.

Additionally, the union charged CNF with bad-faith bargaining. A five-year contract expired Sept. 30, but negotiations had been taking place for a new agreement. Local 11 said CNF “failed to timely respond” to information it had requested relevant to the negotiations.

“This prevented progress in the negotiations before the (decertification) election and restricted the union’s ability to meaningfully respond to the employer’s campaign to convince employees not to vote for union representation,” the complaint alleges.

CNF then presented a “last and final” offer to Local 11, even though negotiations were still ongoing. When the union refused to take the proposal back to its members for a vote, CNF posted the offer on its company Website.

The complaint is under review by the National Labor Relations Board.
